Because of the unique common law and constitutional history of the Office of the Sheriff, the legal issues Sheriffs encounter are often unique to that Office. Our staff attorneys have over 60 years combined experience in researching issues and giving advice and counsel to Sheriffs and Sheriffs' Offices around the State. County Attorneys and Sheriffs' counselors often consult with our attorneys on the many esoteric matters of law, which impact the Office of Sheriff. In 2007, we issued over 100 legal opinions on matters affecting Sheriffs and their offices.

Review and Monitoring of Legislation Affecting Sheriffs' Offices

Approximately 10,000 bills are introduced each session in the New York State Senate and Assembly. All introductions are reviewed by the New York State Sheriffs' Association to determine if they could have impact on New York State Sheriffs, in such areas as criminal law enforcement, corrections, civil process, court security, 911 and dispatch, labor issues, and administrative issues. Bills which may have an impact on Sheriffs are marked for review and monitoring. Periodic reports on the status of these bills are sent during the legislative year to all Sheriffs, and a full report on all bills passed and acted upon by the Governor (approved or vetoed) is prepared at the end of each year's legislative session and sent to all Sheriffs. Reports and analysis of bills passed are also shared with Sheriffs' personnel at annual training conferences as appropriate.
Additionally, NYSSA often responds to legislators and the Governor's Office on requests for positions or for information on pending legislation affecting Sheriffs' Offices.
